Re: legal rights 1st fiddle: Yes, depending on what state you live in, she can not take the kids out of state unless you give permission or you don't do anything. I hope you already have a lawyer... I will try ro find the form for you.

If she hasn't left yet, your husband can file an emergency motion to prevent her from leaving the state with his child.
If she has left already, your husband can file an emergency motion to have her bring the child back to the state.
