advice mrlament: when my wife left me and moved to another state, she said iwas soon to follow..she needed time. now she having an admitted adulterous affair.
do i have any recourse to have the children returned until a judge can make a judge/court makes a ruling?

It depends on the state in which you were married and resided in. Divorce laws differ among the states. In Louisiana, adultery has to be proven. A lot of lawyers don't even bring it into the proceedings. It's easier to just file "irreconcilable differences".  If a custody battle is involved then you should probably try to get proof of the adultery. Keep your children in mind. They so often get caught in the middle. Even teenaged and married children are affected by divorce.
